Content
All services provided by Just Host may only be used for lawful purposes.
Client is solely responsible for supplying website content, authoring, organisation and images in file format unless Red Prime is agreed and hired specifically for this purpose.
Client agrees to submit final content within ten (10) business days after initial payment for Website Design Services. Client agrees that any content changes after content submission will be billed at a rate of AUD$85 per hour.
Red Prime takes no responsibility for any errors in web content. It is the responsibility of the client to ensure all content is correct before delivery. All images provided by the client for their website must be copyright-approved before delivery. Red Prime is not responsible for the copyright of any supplied images.
All content should be delivered in one package, containing all images, text, captions, etc together with clear instructions on where the content is to go.
Client further agrees to pay AU$24.00 for additional image designed by Red Prime.
Client is responsible for keeping a copy of the most current Website files as backup on a remote system. Red Prime is not responsible for any lost files, information or data.
Change Requests
Once the construction phase is completed Client agrees to collect all feedback and desired changes and record into Red Prime's 'feedback form', via email to Red Prime, within 5 working days.
If feedback is not received on time, Red Prime is not held liable for any additional costs required to extend the project timeline.
Privacy Policy
Red Prime will never provide or sell any of your personal information to anyone for any purpose. Any personal and contact details gathered on this website will only ever be used for our own contact purposes.
Copyright
The client represents to Red Prime unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to Red Prime for inclusion in web pages are owned by the client, or that the client has permission from the rightful owner to use each of these elements, and will hold harmless, protect, and defend Red Prime and its subcontractors from any claim or suit arising from the use of such elements furnished by the client. Client is not allowed to sell the customised website program or use it for other purpose without permission from Red Prime.
In any case, Red Prime retains the right to use any work for portfolio purposes.
Authorship Credit
Client agrees that Red Prime may put a testimonial and copyright notice of the project that Red Prime may advertise client's website as an example of their work.
Liability
Red Prime cannot be held liable for any loss of business, business interruption, loss of business information, or any other form of loss caused by our work which never goes public unless it has been approved by the client so the client is held fully liable for their own actions.
Red Prime does not warrant that the functions contained in these web pages or the Internet web site will meet the client's requirements or that the operation of the web pages will be uninterrupted or error-free. The entire risk as to the quality and performance of the web pages and website is with client. In no event will Red Prime be liable to the client or any third party for any damages, including any lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate these web pages or website, even if Red Prime media & communication has been advised of the possibility of such damages. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
Advice
It is not the intention of Red Prime to sell professional advice. Advice is given free and true as far as we know but cannot be taken as guaranteed truth, more of an opinion. Red Prime cannot be held accountable for apparent misleading advice and urges clients to get outside opinion on any advice that is given.
Payment
In order for Red Prime to remain in business, payments must be made promptly. Delinquent bills will be assessed and a $30 charge if payment is not received within 10 days of the due date. If an amount remains delinquent 30 days after its due date, an additional 10% penalty will be added for each month of delinquency.
If it becomes necessary for Red Prime to bring legal action to collect any sums due under this Agreement, it shall be entitled to collect, in addition to all damages, its costs of collection, including reasonable attorney's fees.
All payments paid to Red Prime are non-refundable.
Web Hosting & Domain Registration
If supplied by Red Prime, Domain Registration and Web Hosting costs must be paid for in full up front.
Red Prime does not provide these services itself but enlists the services from renowned providers of such services. Red Prime is therefore not liable for any loss of business, business interruption, loss of business information, or any other form of loss caused by our suppliers.
If problems do occur with these services Red Prime will assist in resolving issues as best we can. Red Prime cannot make any guarantees of the services or the providers. Such guarantees are left up to the providers themselves.
Changes to initial brief
If Red Prime feels that any item requested by the client does not fit within the initial brief (website planning guide), the client will be notified immediately. The item will then be either quoted separately, or charged as an extra, at full hourly rates of $85/hour.
Red Prime media & communication website
The information contained on www.red-prime.com.au and www.red-prime.com is provided by Red Prime media & communication in good faith on an "as is" basis. The information is believed to be accurate and current at the date the information was placed on this Web Site.
